Warranty Policy
(One-Year Limited Warranty)

This Warranty Policy (“Policy”) forms an integral part of the Terms and Conditions of MyCherry Life Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 10/75, Subhash Nagar, New Delhi – 110027 (“MyCherry”, “Company”, “we”, “us” or “our”). Capitalised terms not defined herein shall have the meanings assigned to them under the Terms and Conditions.
1. One-Year Limited Warranty
1.1 MyCherry provides a limited warranty of one (1) year from the date of delivery for all products purchased from the Platform (“Warranty Period”), subject to the terms, conditions, exclusions, and limitations set forth in this Policy.
1.2 This one-year warranty is provided solely against manufacturing defects and does not constitute an unconditional guarantee of product performance, satisfaction, or suitability.
1.3 The warranty is extended only to the original purchaser of the product and is non-transferable.
2. Nature of Products and Hygiene Limitation
2.1 MyCherry operates in the sexual wellness and intimate lifestyle category, and the products sold are personal, intimate, and hygiene-sensitive in nature.
2.2 Due to the nature of the products, any product whose hygiene seal has been opened, tampered with, damaged, removed, or broken shall immediately become ineligible for warranty, irrespective of whether such tampering occurs within the Warranty Period.
2.3 Any usage of the product, whether partial or complete, shall be deemed as acceptance of the product in satisfactory condition and shall render the warranty null and void.
2.4 The Customer expressly acknowledges that hygiene, safety, and personal use considerations override any warranty claim once the product is opened or used.
3. Scope of Warranty Coverage
3.1 Subject to this Policy, the warranty covers only manufacturing defects that are identifiable prior to opening or using the product.
3.2 Manufacturing defects do not include issues arising from:
• normal wear and tear,
• improper use or handling,
• misuse, abuse, or negligence,
• exposure to moisture, heat, liquids, or external substances,
• unauthorised modifications or repairs,
• failure to follow usage instructions or warnings.
3.3 Cosmetic variations, minor deviations in appearance, packaging damage, or subjective dissatisfaction shall not constitute a manufacturing defect.
4. Warranty Claim Procedure
4.1 Any warranty-related concern must be reported to support@mycherry.in within 48 (forty-eight) hours of delivery, along with:
• proof of purchase,
• unboxing video (where applicable),
• clear photographs or videos of the unopened product and packaging.
4.2 MyCherry reserves the right to inspect, verify, and assess the product before approving any warranty claim.
4.3 Products sent without prior approval or without original packaging shall not be eligible for warranty assessment.
5. Remedy Under Warranty
5.1 If a valid warranty claim is approved, MyCherry may, at its sole discretion:
(a) replace the product with the same or equivalent product, or
(b) provide a refund of the product value.
5.2 Replacement or refund shall be the sole and exclusive remedy available under this warranty.
5.3 Under no circumstances shall MyCherry be liable for incidental, indirect, or consequential damages.
6. Exclusions from Warranty
6.1 Without limitation, the warranty shall not apply to:
• products that have been opened, used, or partially used,
• products with broken or tampered hygiene seals,
• products damaged after delivery,
• products used contrary to instructions,
• issues arising due to personal sensitivity, allergy, or reaction,
• dissatisfaction with product results or experience.
6.2 Products purchased during promotional, clearance, or discounted sales shall be covered by the same warranty exclusions.
7. Limitation of Liability
7.1 MyCherry’s liability under this Policy shall be limited strictly to the purchase price of the product, excluding shipping charges.
7.2 This Policy does not create any additional rights beyond those expressly stated herein.
8. Final Authority
8.1 All warranty-related decisions, including eligibility, assessment, remedy, or rejection, shall be taken at the sole discretion of MyCherry, and such decisions shall be final and binding.
9. No Implied Warranty
9.1 Except as expressly stated in this Policy, no implied warranties, including warranties of merchantability or fitness for a particular purpose, are provided to the maximum extent permitted by law.
