1. Introduction and Applicability

1.1 This Privacy Policy (“Policy”) describes how MyCherry Life Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 10/75, Subhash Nagar, New Delhi – 110027 (“MyCherry”, “Company”, “we”, “us” or “our”), collects, receives, stores, processes, uses, shares, transfers, and protects personal data of individuals (“you”, “your”, “user”) who access or use our website, mobile site, applications, chat interfaces, artificial intelligence tools, expert assistance modules, newsletters, customer support channels, and related services (collectively, the “Platform”).

1.2 This Policy is framed in accordance with applicable Indian laws, including the Information Technology Act, 2000, associated rules, and the Digital Personal Data Protection Act, 2023, and shall be read together with our Terms and Conditions, Shipping Policy, and Returns & Refund Policy.

1.3 By accessing, browsing, registering on, purchasing from, or otherwise using the Platform, you expressly consent to the collection, use, processing, storage, disclosure, transfer, and retention of your personal data in accordance with this Policy. If you do not agree, you must immediately discontinue use of the Platform.

2. Eligibility and Children’s Privacy

2.1 The Platform is intended strictly for individuals who are 18 (eighteen) years of age or older.

2.2 MyCherry does not knowingly collect personal data from minors. Any access or data submission by a minor shall be deemed unauthorised.

2.3 If a parent or legal guardian believes that a minor has provided personal data on the Platform, they may contact us for deletion of such data, subject to verification.

2.4 MyCherry shall not be liable for any misrepresentation of age by users.

3. Nature of Business and Sensitive Category Disclosure

3.1 MyCherry operates in the sexual wellness and intimate lifestyle category, and users may voluntarily share information that is sensitive or personal in nature, including queries, preferences, or feedback related to sexual wellness products.

3.2 Such information is collected strictly on a voluntary basis and processed with heightened confidentiality, security safeguards, and access controls.

3.3 MyCherry does not require users to disclose sexual orientation, preferences, or intimate information to access the Platform, and any such disclosure is optional.

4. Categories of Personal Data Collected

4.1 MyCherry may collect personal data actively provided by users, including name, email address, phone number, delivery address, login credentials, age confirmation, order details, feedback, communications sent through emails, customer support, chat interfaces, expert assistance tools, surveys, or social media interactions.

4.2 MyCherry may collect information relating to your purchases, cart activity, order history, refunds, discounts, referral programs, and interactions with promotional campaigns.

4.3 MyCherry may automatically collect technical and usage data arising from your interaction with the Platform, including IP address, browser type, device identifiers, operating system, language preferences, access dates and times, pages viewed, crash logs, referring URLs, and system activity.

4.4 Payment-related information such as card details, UPI credentials, or banking information is collected and processed directly by authorised third-party payment gateways such as Razorpay. MyCherry does not store or retain such financial information.

5. Information Collected Through AI Tools and Expert Assistance

5.1 The Platform may offer expert assistance features, automated chat interfaces, or AI-powered tools designed to respond to general product-related or wellness-related queries.

5.2 Information shared through such tools may be processed to respond to queries, improve service quality, train AI systems in an anonymised or aggregated manner, and ensure compliance with applicable laws.

5.3 Such interactions do not constitute medical records, and no medical, psychological, or therapeutic advice is provided.

6. Information Received from Third Parties

6.1 MyCherry may receive limited personal or technical data from third-party service providers, including Shopify (e-commerce infrastructure), logistics partners, analytics providers, marketing platforms, and customer support tools, strictly to enable Platform functionality and order fulfilment.

6.2 Such data is processed in accordance with this Policy and applicable law.

7. Purpose of Data Processing

7.1 Personal data is used to operate, maintain, personalise, and improve the Platform, create and manage user accounts, process and deliver orders, provide customer support, communicate transactional messages, detect fraud, prevent misuse, conduct analytics, perform research and development, improve user experience, and comply with legal and regulatory obligations.

7.2 With user consent, personal data may also be used for marketing communications, promotional outreach, feedback analysis, and internal business analytics.

8. CONSENT POLICY

9.3 Users may control or disable cookies through browser settings; however, disabling cookies may limit Platform functionality or performance.

9.4 Continued use of the Platform constitutes consent to the use of cookies in accordance with this Policy.

10. Sharing and Disclosure of Personal Data

10.1 MyCherry does not sell or rent personal data to third parties.

10.2 Personal data may be shared with service providers, logistics partners, payment gateways, analytics providers, professional advisors, or affiliates strictly on a need-to-know basis and subject to confidentiality obligations.

10.4 In the event of a merger, acquisition, restructuring, or sale of assets, personal data may be transferred as part of such transaction, subject to applicable law.

11.1 Due to the use of global service providers such as Shopify, personal data may be processed or stored on servers located outside India.

11.2 MyCherry ensures that reasonable contractual, technical, and organisational safeguards are implemented to protect such data.

12.2 Certain data may be retained even after account deletion where required by law or regulatory obligations.

13.1 MyCherry implements reasonable technical and organisational security measures, including encryption, access controls, monitoring, and internal policies, to protect personal data.

13.2 Despite such measures, no method of transmission over the internet or electronic storage is completely secure, and MyCherry cannot guarantee absolute security.

14.2 Exercise of such rights may be subject to verification and legal limitations.
