RETURNS & REFUND POLICY

This Returns and Refund Policy (“Policy”) forms an integral part of the Terms and Conditions of MyCherry Life Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 10/75, Subhash Nagar, New Delhi – 110027 (“MyCherry”, “Company”, “we”, “us” or “our”). Capitalised terms not defined herein shall have the meanings assigned to them under the Terms and Conditions. 

MyCherry operates in the sexual wellness and intimate lifestyle category. Due to the personal, intimate, and hygiene-sensitive nature of the products, MyCherry follows a restricted and category-specific returns and refund policy, consistent with industry standards followed by major e-commerce marketplaces such as Amazon and Flipkart for similar product categories. 

1. General Policy on Returns and Refunds

1.1 All products sold on the Platform are intended strictly for personal use and are, by default, non-returnable and non-refundable, except in cases expressly covered under this Policy.

1.2 Returns or refunds shall be considered only in the event that the Customer receives:

(a) a wrong product,

(b) a product that is physically damaged at the time of delivery, or

(c) a product with missing items or components.

1.3 Returns or refunds shall not be accepted for reasons including, but not limited to, change of mind, dissatisfaction with product performance, personal preference, sensitivity or allergic reaction, incorrect product selection by the Customer, or misuse of the product. 

2. Conditions for Return Eligibility

2.1 Any request for return, replacement, or refund must be raised within 48 (forty-eight) hours from the time of delivery by contacting support@mycherry.in.

2.2 The product must be unused, unopened, untampered, and in its original packaging, with all seals, labels, tags, manuals, accessories, and hygiene seals intact.

2.3 Products that are opened, used, partially used, tampered with, damaged after delivery, or returned without original packaging shall not be eligible for return or refund under any circumstances.

2.4 MyCherry reserves the right to inspect and verify the condition of the product, packaging, and accompanying materials before approving any return, replacement, or refund request. 

3. Damaged, Defective, or Incorrect Products

3.1 In case a Customer receives a damaged, defective, or incorrect product, the Customer must provide clear photographic or video evidence, including images of the outer packaging, inner packaging, and the product itself, at the time of raising the request.

3.2 Upon verification, MyCherry may, at its sole discretion, offer either:

(a) a replacement of the same product, or

(b) a refund, subject to product availability and internal assessment.

3.3 Replacement shall be provided only once per order. Repeated or excessive claims may result in rejection of future requests. 

4. Non-Returnable and Non-Refundable Items

4.1 Without limitation, the following shall be strictly non-returnable and non-refundable:

• Opened or used sexual wellness products

• Products with broken or removed hygiene seals

• Products returned without original packaging or accessories

• Products damaged due to misuse, negligence, or improper handling

• Products purchased during clearance, promotional, or sale events, unless delivered damaged or incorrect

4.2 These restrictions are implemented strictly in the interest of health, hygiene, safety, and consumer protection, and are consistent with marketplace standards for intimate and personal care products. 

5. Refund Processing

5.1 Refunds, where approved, shall be processed using the original mode of payment within 7 to 10 business days from the date of approval.

5.2 For Cash on Delivery (COD) orders, refunds shall be processed via bank transfer or any other method determined by MyCherry, subject to the Customer providing valid bank account details.

5.3 MyCherry shall not be responsible for delays caused by banks, payment gateways, or third-party service providers. 

6. Order Cancellation

6.1 Orders may be cancelled only before dispatch of the product.

6.2 Once an order has been shipped or handed over to the Delivery Partner, cancellation requests shall not be accepted.

6.3 MyCherry reserves the right to cancel orders at its discretion in cases of suspected fraud, incorrect pricing, inventory errors, operational issues, or violation of the Terms and Conditions. 

7. Limitation of Liability

7.1 MyCherry’s liability, if any, arising out of returns, replacements, or refunds shall be limited strictly to the amount paid by the Customer for the product, excluding shipping charges and ancillary costs.

7.2 Under no circumstances shall MyCherry be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use the product. 

8. Final Authority

8.1 All decisions regarding eligibility for return, replacement, refund, or cancellation shall be taken at the sole discretion of MyCherry, and such decisions shall be final and binding.
